(Central News Agency reporter Huang Xusheng, New Taipei City, 24th) The New Taipei City Health Bureau stated that it has sent personnel to investigate the suspicious privacy photos of patients at Taipei Tzu Chi Hospital, and issued a document today asking the hospital to initiate an investigation and submit a report within three days. In addition, if the investigation by the prosecutors and police is found to be true, the hospital may be fined up to 250,000 yuan; if the nurse is involved in the case, the hospital may be suspended from business for one year.

A male nurse surnamed Huang from Taipei Tzu Chi Hospital posted an article and uploaded photos on the Internet, saying that a hospital nurse took private photos of patients after anesthesia in the operating room. Huang was charged by the police with obstructing confidentiality and other crimes.

The Taipei District Prosecutor’s Office summoned Mr. Huang to present his case and ordered him to post a bail of NT$100,000 yesterday. Because Huang was unable to find bail, the prosecutor changed his order to restrict his residence.

Yang Shihao, a special committee member of the Municipal Health Bureau, said in a telephone interview with a reporter from Central News Agency today that he has sent personnel to Taipei Tzu Chi Hospital to investigate the matter of taking private photos alleged by the whistleblower. Due to the lack of specific evidence such as the person involved, the time, and the location of the operating room, etc., The case is currently under investigation by the hospital and prosecutors.

He said that after inspection, Taipei Tzu Chi Hospital’s patient privacy regulations, standard operating procedures, announcements, etc. were not lacking. A document will be sent to the hospital today, requiring an investigation report and explanation of the case to be submitted within three days.

The Health Bureau said that hospitals and clinics will only install video recording equipment in public areas; out of consideration for patient privacy, no monitors will be installed in clinics, operating rooms, etc. The Health Bureau will also list it as one of the inspection items every year.

The Health Bureau stated that if the follow-up inspection proves that hospital personnel took pictures of patients’ bodies after anesthesia, the relevant behavior may involve violating the medical law, and the hospital may be fined NT$50,000 to NT$250,000.

The Health Bureau said that if the nursing staff law is involved and there is illegal or improper behavior in business, the nursing staff can be suspended from business for more than one month and less than one year; if the circumstances are serious and criminal liability is involved, the case will be transferred to the prosecutor.
