According to the current employment law, illegal employers who hire missing migrant workers will be fined NT$150,000 to NT$750,000, and illegal media outlets will be fined NT$100,000 to NT$500,000. Those who intend to make illegal media for profit will be fined NT$150,000 to NT$750,000. The offender will be sentenced to fixed-term imprisonment of not more than 3 years, criminal detention, or a fine of not more than 1.2 million yuan.

Minister of Labor Hsu Ming-chun went to the Legislative Yuan Committee on Social Welfare and Health and Environmental Protection today to conduct a project report on “The Employment Service Law has been in place for more than 30 years and will conduct a comprehensive review on employment promotion, prohibition of discrimination, and protection of the rights and interests of foreign workers.”

Regarding the focus of future law revision, Xu Mingchun said that in order to strengthen deterrence and severely punish illegal accommodation, employment, and illegal mediaforeignerRegarding work and other behaviors, the Ministry of Labor has drafted a draft amendment to some provisions of the law. In the future, for illegal employment and illegal media, the current penalty will be increased from the current case-by-case basis to the per-person calculation, and the illegal media fine will be increased by 3 times. From the current fine of NT$100,000 to NT$500,000 per case, the fine will be increased from NT$300,000 to NT$1.5 million per person based on illegal media, and the relevant criminal liabilities will be aggravated.

In addition, the draft amendment is also expected to prohibit employers and agency companies from keeping the documents of job seekers and migrant workers, and increase the number of years for illegal control of alien applicants. For employers who are found guilty of personal abuse of foreigners by the court, it will be increased from 2 years to 5 years. Repeat offenders will be permanently banned from hiring foreigners.
