The Tainan District Prosecutor’s Office investigated a case of collusion between optoelectronics companies and civil servants for profit and disadvantage. On the 26th, they investigated and prosecuted 15 officials and businessmen, including former Tainan City Government Economic Development Director Chen Kailing and Li Yang Group President Gu Shenghui. Prosecutors estimate that the government and businessmen involved in the case jointly sought to profit five companies by illegally setting up the case, and the revenue from electricity sales in 20 years will reach more than 9.12601 billion yuan.

The Tainan District Prosecutor’s Office pointed out that in 2022, prosecutors were investigating a case of suspected embezzlement by a lessee of state-owned non-public land for renting out and setting up solar photovoltaic power generation equipment for use. They discovered that the Liyang Group was engaged in land consolidation in the Qigu District area of Tainan and was suspected of being illegal. Under the instructions of the former Prosecutor General Ye Shuwen, a special task force was set up to separate the case. Six searches were carried out, 68 locations were searched, a large number of exhibits and 37.8 million yuan in cash were seized, and a total of 246 defendants and witnesses were interrogated.

Prosecutors investigated and found that Liyang Group President Gu Shenghui helped five companies in the group, including Tianying, Tianxin, Tianzhu, Tianren and Tianrui, to apply for the use of non-urban land with an area of less than 2 hectares (commonly known as Xiaoerjia). The land type was changed to be used for solar photovoltaic facilities, and we worked with Tainan City Government Economic Development Director Chen Kailing and other civil servants to plan a solution to the ban on minor errands in order to avoid the more complicated review procedures and reduce the expenses required to apply for development projects.

Gu Shenghui and others sought to review the cases of small and medium-sized second-class companies and be able to continue to submit applications without being affected by the ban on small and medium-sized companies. In September 2021, they reported to the Energy Bureau of the Ministry of Economic Affairs and the Economic Development Bureau of the Municipal Government, Please submit that if you can provide supporting documents such as a land ownership consent letter signed with the landowner before July 31, 2020, it can be included in the scope of the “109-year Solar Photovoltaic 6.5GW Standard Compliance Plan” and will not be exempted from Xiaoerjia Injunction affects claim.

The then team leader of the Solar Photovoltaic Group of the Energy Bureau of the Ministry of Economic Affairs, Lin, Chen Kailing and others all knew that the Lishan Group was not affected by the Xiaoerjia ban as the site for filing the case, so they would apply for a land use consent form with an incorrect date, and it was already in the 110th year at that time. , and does not comply with relevant operating regulations. Yingu continued to ask and put pressure on him, but actually agreed to his proposal, and held a photovoltaic promotion discussion meeting to gradually include the Liyang Group’s application cases into the recognition of the 109-year solar photovoltaic 6.5GW compliance plan. Within the format, the more complicated review procedures are avoided.

The prosecutor pointed out that five civil servants including Chen Kailing and 10 members of the Liyang Group including Gu Shenghui participated in the plan to solve the ban on minors. The members of the Liyang Group submitted land use consent documents with false dates to the Economic Development Bureau. The original application documents enabled Wutian Company to successfully obtain the letter of approval for the business plan after being reviewed by relevant units, which was beneficial to Wutian Company and Liyang Group.

The Energy Bureau held a terrestrial photovoltaic promotion meeting led by Lin and Chen in September and October 2021. The Liyang Group’s appeal was officially included in the review scope of the 109 Solar Photovoltaic 6.5GW compliance plan, and Liyang Group was The Yang Group produced a “Solar Photovoltaic Facilities Construction Business Plan and Agricultural Land Change Instruction Manual” with an inaccurately dated land use consent document, and submitted it to the Economic and Development Bureau to replace the original business establishment and agricultural land use consent document or apply separately, and Chen directed it to be issued. The bureau undertook civil servants to determine that Liyang Group’s supplementary information and instructions for successive applications for business establishment and 4 agricultural changes are in line with the review and approval status of the 109-year solar photovoltaic 6.5GW compliance project, and are not affected by the ban on minors.

The Energy Bureau of the Ministry of Economic Affairs and other units also carried out follow-up review work based on this, and approved the consent letter for the establishment of the power generation industry and the consent letter for the change of agricultural land use. The Economic Development Bureau issued a consent letter for the establishment of Wutian Company’s business plan, making Wutian Company Therefore, the provincial expenses required to apply for a development project include technician visa fees, development impact fees, outflow control planning documents and plans, etc. totaling approximately 8.3 million yuan, and Tude can continue to use the leased land to install solar photovoltaic benefits. The state’s illegal profits are estimated to be more than 9.126 billion yuan.

Prosecutors believe that former Economic Development Director Chen Kailing, then chief secretary Wang, Energy Department Commissioner Qiu, Energy Department Zhang and others are involved in corruption, civil servants seeking profit from supervision affairs, and using civil servants to publish false documents. . The then leader of the Solar Photovoltaic Group of the Energy Bureau of the Ministry of Economic Affairs, surnamed Lin, was involved in the Corruption and Corruption Regulations, and was suspected of seeking profit by a civil servant in supervising affairs. In addition, Liyang President Gu Shenghui, general manager surnamed Xu, senior associate manager surnamed Lin of the design department, senior manager surnamed Xie of the electrical engineering department, manager surnamed Ding of the land planning department, acting team leader surnamed Li, team leader surnamed Du and Zhu of the task force The commissioner surnamed Qiu, the assistant manager of the Ministry of Land Development surnamed Qiu, and the senior manager surnamed Zhang are all involved in the corruption offenses regulations. Non-civil servants and civil servants are suspected of collaborating with civil servants to profit from supervisory and supervisory affairs, and they are suspected of using civil servants to publish false documents.

The prosecutor believed that the team leader surnamed Lin and Chen Kailing knew that Gu Nan had violated the law, but still encouraged the illegal situation and shirk responsibility, showing no remorse; Gu Nan and other senior management of Liyang Group did not think about operating properly, but abused their power to influence the ethics of civil servants and undermine the public affairs. I believe you should be punished severely.
